Teresa and Elena Mensch allege that Richard Pollard sexually abused them when they were young children but that their memories of the abuse were repressed and not recovered for many years. Pollard moved in limine to exclude lay and expert testimony on repressed memory and, after a pretrial evidentiary hearing, the trial court entered findings and conclusions which provided: (1) expert testimony on repressed memory is inadmissible at trial; (2) lay testimony on repressed memory is admissible; and (3) expert testimony on Statement Validity Analysis (SVA) is inadmissible.The court also found "no just reason for delay" of our review of these evidentiary issues and certified them for interlocutory review. Accordingly, the Mensches brought this appeal challenging the trial courts preclusion of expert testimony on repressed memories and SVA.
